Moorhead Circle <br /> Boulder, CO 80303 <br /> RE: Concerns regarding the Deepe Farm Pit File No. M-81-302 <br /> and the Turnpike Pit - File No. M-78-064 <br /> Dear Dr. Bunin: <br /> As a follow up to inspection reports of July 29 , 1996 which have <br /> been sent to you, the reports of August 16, which will be sent <br /> this week, and the concerns you expressed in your letter of July <br /> 15, 1996 addressed to the Colorado Mined Land Reclamation Board <br /> (MLRB) , I am providing you with the following information. Also, <br /> we have forwarded your letter on to the MLR Board members . <br /> Issue 1 - TOPSOIL AND FUTURE LAND USE - <br /> Items 1 (a) (b) (c) (e) (g) (h) (i) (j ) (k) <br /> Response <br /> The Division of Minerals and Geology (The Division) assumes that <br /> your "no commitment to topsoiling" comment refers to the request <br /> for an amendment by the operator received by the Division on May <br /> 1, 1989 . <br /> On the second page of the narrative of this submittal the <br /> applicant proposes that "the dry land be topsoiled according to <br /> the amount of topsoil available on site rather than the 6 to 8 <br /> inches . " This was not a request for spreading no topsoil but <br /> rather is a commitment to spreading the topsoil which is on the <br /> site. Such a request is in conformance with Rule 3 . 1 . 9 (1) of the <br /> Construction Materials Rules which states "Where it is necessary <br /> to remove overburden in order to mine the construction material , <br /> topsoil shall be removed and segregated from other spoil . <br />
