Long <br />Divrsion Direnor <br />Re: Horvath Pit No 1, Permit No. M-77-546, Annual Fee and Report, Notice of <br />Violation No. M-93-042 <br />TO WHOM IT MAY CONCERN: <br />C.R.S. 34-32-116(3) and (4), and Permit No. M-77-546 require you to submit an <br />annual fee and an annual report on or before July 26 of each year. As of this <br />date, the Division of Minerals and Geology (the "Division") has not received your <br />annual fee of $225.00 and report for July 27, 1992 through July 26, 1993. <br />Therefore, you are in violation of the above cited statutes and the provisions of <br />Permit No. M-77-546. Also, be aware that no new permits for mining operations <br />shall be granted to you (C.R.S. 34-32-120) until the violation is abated with the <br />State of Colorado. Pursuant to C.R.S. 34-32-124(7), as amended, you are hereby <br />assessed a civil penalty in the amount of $225.00. <br />If you fail to submit the annual fee, annual report, and the assessed civil penalty <br />by November 30, 1993, this matter will be scheduled for Formal Public Hearing <br />before the Mined Land Reclamation Board for consideration of a Cease and Desist <br />Order at the December 15-16, 1993 Board Meeting. <br />IN ORDER TO AVOID A CEASE AND DESIST ORDER, PLEASE SUBMIT $225.00 FOR ANNUAL FEES, <br />$225.00 FOR THE CIVIL PENALTY (FORA IOTAL OF $450.00), AND YOUR ANNUAL REPORT BY <br />NOVEMBER 30, 1993. <br />The Board Meeting will be held on Cecember 15 and 16, 1993, in Room 318 of <br />1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m. or as soon thereafter <br />as the matter can be considered, and you will have the opportunity to be <br />represented and heard. <br />If you have any questions, please contact Barbara Chiappone. <br />~~Sincerely, <br />-~ <br />MICHAE~NC,\ DiTee-tex_~ <br />CERTIFIED MAIL N0.
