Long. <br />Division Director <br />The Colorado Mined Land Reclamation Board on April 23, 1992 found Albert Frei <br />and Sons, Inc., in violation of the Colorado Mined Land Reclamation Act <br />(34-32-101 et sec., C.R.S. 1973 as amended) for disposal of off-site materials <br />at the site. The Board issued an immediate Cease and Desist order to stop <br />importing off-site fill materials, and asked for a written notice of <br />compliance, and ordered a technical revision for the 1 acre fill area. The <br />Board also assessed a 5150.00 civil penalty to be paid by the 27th day of May, <br />1992. <br />On May 4, 1992 the Mined Land Reclamation Division received Frei's written <br />Letter of Compliance with the Cease and Desist Order. The technical revision <br />was submitted of April 15, 1992 and approved on April 24, 1992. The Division <br />also received the 5150.00 civil penalty on May 4, 1992. <br />As such, Albert Frei and Sons, Inc., has satisfied all the conditions ordered <br />through Notice of Violation No. M-92-025 issued at the April 23, 1992 Board <br />meeting.
