<br />Should the unforeseen happen and our water supply and ultimately our <br />livelihood and the public safety become endangered who then will be <br />responsible? We strongly urge the Board to require BMG to increase their <br />financial security, extend water monitoring period after the mine shuts down, <br />and call for third party review the reclamation plan to avoid another <br />Summitville. <br />P.A.E.S would also like to request that the board take formal act~on to <br />I <br />prohibit BMG and /or the landowners of the EI Pomo Mining Site from <br />promoting the tailings site as a landfill to Costilla County. We request that this <br />action disallow the sale, deeding, or donation of the impacted areas ofthe <br />mining site and tailings pond to the Costilla County. We feel that the County <br />and the tax payers could become an unknowing party to such an offer'Mnthout <br />understanding that they could incur financial liability, along with BMG hand the <br />landowners, in the event that ground water becomes contaminated arjd or <br />other federal and or state environmental laws are violated.
