A subsequent engineer's report, dated March 20, 1995, recommends that Energy <br />Fuels Mining Company needs to seed and mulch the area. <br />Third, soil stabilization practices were not conducted. Energy Fuels Mining Company was <br />aware of the continuing rill formation on the reclaimed site. Comments regarding the <br />formation of rills are found in the Division's inspection reports dated January 24, 1995, <br />May 9, 1995, and June 1, 1995. Energy Fuels did conduct chiselling on the contour prior <br />to the Division's February 22, 1995 inspection to impede the rill formation. <br />The Trinidad area experienced a rather dry winter, that extended well into April, 1995. <br />Seeding operations could have been wnducted in March or early April. At the time of the <br />March 8, 1995 bond release inspection, site conditions were dry. The Division agrees that <br />weather conditions during May were unusually wet and may have hampered seeding <br />operations; however, the Division's May 9, 1995 inspection report indicated that site <br />conditions were dry at the time of the May 9, 1995 inspection. <br />Energy Fuels Mining Company states that construction work to bring the catchment basin <br />area and the slope identified in the Phase I bond release inspection into compliance delayed <br />the seeding operations as well. The Catchment basin area and the southern slope of the <br />substation, however, entailed a minor portion of area, approximately 1.5 acres. The Division <br />believes that seeding operations could have commenced throughout the permit area with the <br />specific construction sites being seeded once construction had been completed. <br />After review of these facts regarding Notice of Violation C-95-018, I believe the facts <br />support the issuance of this violation.
