AM-01 proposes to excavate <br />construction materials from a river terrace, adjacent to the Animas River and located within the <br />100 year floodplain. The application contains designs for river jetty and embankment <br />reinforcement, prepared and certified by a Professional Registered Engineer, certifying that the <br />proposed plans provide an appropriate safety factor to be able to resist effects of the 100 year <br />precipitation event on the river channel. <br />OTHER PERMITS AND LICENSES <br />Applicant is pursuing approval for the plans through the U.S. Army Corps of Engineers. The site <br />includes an abandoned sewage treatment facility, to be removed by mining activities. The <br />applicant has informed CDPHE of the abandoned facility and has committed to comply with <br />CDPHE requirements. Due to high water table, pit dewatering will be necessary. The application <br />indicates that a discharge permit through CDPHE-WOCD, and a well permit through OSE-DWR, <br />will be acquired. Additionally, applicant is pursuing approval for the expansion through the La <br />Plata County Planning Department. <br />RECLAMATION PLAN <br />Final Land Use: Wildlife Habitat <br />Slope Grading: 3H:1 V pond inslopes, 2H:1 V embankment outslope <br />Topsoil Depth: 12 - 14 inches <br />Revegetation Mix: Various species of native and introduced grasses and sedges <br />Willow shrubs and Cottonwood tree transplants near water level <br />STAFF RECOMMENDATION Staff have determined that the application has <br />demonstrated compliance with the requirements of C.R.S. 34-32.5-115(4), and therefore <br />recommend that the Board approve the application for AM-01 to the Thomas Pit permit. Staff <br />have estimated the total cost of reclamation for the first year of operations at $30,812. <br />Therefore, staff recommend that Financial Warranty be set at $30,812. <br />
