M-1986-007, <br />NOV MV-2000-030 <br />THIS MATTER came before the Mined Lands Reclamation Board on October 18, 2000 at Glenwood <br />Springs, Colorado for hearing on a notice of alleged violation pursuant to § 34-32.5-124, C.R.S. Christina <br />Kamnikar appeared on behalf of the Division of Minerals and Geology. Glenn Southwick represented Bacon & <br />Southwick S&G. The Board, having considered the notice of violation, the testimony and exhibits of the <br />parties, and having been otherwise fully informed in the premises, hereby finds and concludes as follows: <br />FINDINGS OF FACT AND CONCLUSIONS OF LAW <br />I. The Division is alleging a possible violation of disturbing land outside of the permit area by Bacon & <br />Southwick at its Masonville Stone site. This site is located in Section 26, T6N,R70W, 6th P.M., Lorimer <br />County, Colorado. <br />2. The Division inspected this site on May 9, 2000, in response to a complaint received through the Lorimer <br />County Planning Department. <br />3. The Division found that a 15' long chicken-wire restraint area between two trees on the north side of the <br />site, and below the main excavation area, had collapsed. This left a hole in the restraint netting that allowed <br />rocks from the terrace above to tumble down, through the gap, and into the creek. <br />4. During afollow-up inspection on June 21, the Division found site boundary markers. The markers indicated <br />that the area affected by quarry debris that slid down the hillside toward the creek is outside the permit area. <br />This area was approximately 200' wide by 45' deep, for an area of approximately 0.2 acres. A review of <br />both the earliest maps submitted for the site, and site photographs taken in June 1981, prior to the <br />excavation of the site, further support the conclusion that the disturbance of the site slopes was outside the <br />permit boundaries. <br />
