~ III IIIIIIIIIIIII III ~ <br />STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE NATTER OF: Andersen ) NOTICE OF VIOLATION M-87-037 <br />Construction Company ) AND <br />CEASE AND DESIST ORDER <br />T0: Mr, Dale Andersen and all other persons engaged in or owning or <br />controlling the following operation: Midway Gravel Pit; File No. M-80-086. <br />FINDINGS OF FACT <br />Pursuan+: to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-124, the Board hereby makes the following <br />findings of fact: <br />1. AndE~rsen Construction Company is permitted to conduct a mining operation <br />under tiie terms of Permit M-80-086 located in Section(s) 22, Township 175, <br />Range 6',iW of the 6th P.M., in E1 Paso County, Colorado. <br />2. The Mined Land Reclamation Board conducted a Formal Public Hearing on <br />August 26, 1987 to consider possible violation of the terms of Permit M-80-086 <br />and C.R.S. 34-32-101 et seq. <br />3. The Mined Land Reclamation Division presented evidence at the Formal <br />Public Flearing on August 26, 1987, demonstrating that: <br />1. Andersen Construction Company has mined approximately 30 to 35 <br />acres at: this site. The site was permitted for 9.9 acres of disturbance. <br />
