During the construction <br />project, we experienced an unusual number of days of rain and snowfall. <br />While the rain and snow was not heavy it persisted for three or four days at <br />a time. We found that it was almost impossible to achieve the 95% compaction <br />of the lifts due to the high moisture content of the soil. In addition, our <br />heavy equipment used to construct the pond were constantly becoming stuck <br />in the mud and snow. These factors forced us to delay construction of the <br />pond for two or three days after every percipitation event in order to let <br />the soil dry up. <br />When I took over Craig Sherwood's position here at Snowmass, I was un- <br />aware of the time limit that you stated in your letter of May 10, 1982. <br />I did not become aware of this time limit until I discussed the situation <br />with you last week. I realize that you are concerned about the runoff next <br />spring. Therefore, I hereby submit the following plan to allow Snowmass <br />Coal extra time in which to complete the pond. <br />Since the pond is almost completed except far the spillways and a little <br />more earthwork, Snowmass Coal proposes to have a registered engineer certify <br />the existing portion of the pond. The ditches and culverts now leading to <br />this pond will be checked weekly to make sure they are not obstructed. When <br />the spring runoff has started, the water level of the pond will be checked <br />every day. As soon as the water level reaches 80% of its existing volume, <br />the water will be pumped from the pond into a water truck. The water truck <br />will then truck the water to one of the other disturbed water ponds (Pl or <br />P9), and discharge its water. As soon as it is feasibly possible, the pond <br />will be completed to the specifications it was designed to. <br />
