Long <br />Division Direcror <br />RE: Request for Vacation, Western Fuels-Colorado, The New Horizon <br />Mine, Permit No. C-81-008, Notice of Violation No. C-92-024 <br />Dear Mr. Shrestha: <br />The Division on October 13, 1992, received ycur request for vacation <br />of Notice of Violation No. C-92-024. This NOV was issued on <br />August 26, 1992 for Western Fuels-Colorado`s failure to comply with <br />Rule 4.05.6(3)(e) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining (revised yTune 30, 1991}. <br />I have reviewed your request and do not find justification for <br />vacating this violation. I do however find that given the on-site <br />conditions, a reduction of $250.00 of the Seriousness component of <br />the civil penalty assessment is warranted.
