IN10 ~1AIN HA1ER5 <br />Pursuant to Section 404 of the Clean dater Act (33 OSC 1344) std federal reguLtions x;33 ffR 330.5), a <br />nationwide permit for discharges of dredged or filltsaterial into certain eaters of the Onited States <br />has been issued, subject to the limits and eosditione listed below. the permit, faced a[ 33 ffR <br />330.5(x)(26), authorizes the dixhaxge of dredged or fill material into the follovirg3 eaters of the <br />Lhited States: core-tidal rivers, sere~s sd their Lkes acd i~asdm~tts, imludirg adjacent vetlads, <br />that axe located above the headwaters; acd other mcrtidal eaters of the Chita! States 12iat are rat part <br />of a surface tributary system to interstate eaters of rtarigable eaters of the Unit:ai States (i.e., <br />located in a closed basir>1. the term "headwaters" meals that point on a perennial stream where the <br />average anraral flow is five ctbic fee[ per second. Qn an intermittent stream, the "lterdwaters" is that <br />point where a floe of five ctbic feet per secocd is equaled or accealed 50 percent of Uie tine.
