Heifner <br />37 East Colorado Avenue <br />Denver, Colorado 80210 <br />Dear Mr. Heifner: <br />RECL MATIpN p ~ ~I`~N <br />Reference is made to your letter dated January 5, 1990, <br />regarding Castle Concrete's proposed filling in of an existing <br />pond and construction of a sediment control basin on a tributary <br />of Black Canyon which is known locally as Snyder Fork of the <br />Black Canyon. The project site is located about one mile north <br />of Manitou Springs, E1 Paso County, Colorado, in the center of <br />532, T13S, R67W. <br />Regulations pursuant to Section 404 of the Clean Water Act <br />(33 CFR 330.5(a)(26)) describe a nationwide permit for discharges <br />of dredged or fill materials into certain waters that are located <br />in closed basins or above the headwaters of waters of the United <br />States. A summary of the provisions of this permit and a <br />brochure about our regulatory program are enclosed for your <br />information. <br />The described project site is located above the headwaters. <br />The project can be constructed provided it does not result in the <br />loss or substantial adverse modification of more than one acre of <br />waters of the United States, including wetlands. Acreage must be <br />figured as a total for all dredged and fill activities in waters <br />of the U.S. within the Snyder Quarry. It appears that a total of <br />about 0.3 acre of waters would be affected by the project. The <br />officer responsible for the project must insure compliance with <br />all conditions of the permit. <br />For discharges which cause the loss or substantial adverse <br />modification of one to ten acres of such waters, including <br />wetlands, notification is required in accordance with the <br />procedures listed in the summary. Discharges resulting in the <br />loss or substantial adverse modification of more than ten acres <br />of these waters will require an individual Section 404 p,=_rmit. <br />You are advised that this verification of the natiomaide <br />permit authorization is valid for two years. The natiomaide <br />permit will be in effect until November 13, 1991, unless it is <br />sooner reissued, modified, or rescinded. <br />
