C-83-e5R: notice of <br />Violation no. C-93-104, dated June 29, 1993 <br />Dear Mr. Hernandez: <br />Reference is made to subject "notice of Violation" and our <br />telephone conuersation of July 15, 1993. I feel it is necessary <br />to clarify some of the background and thinking in development and <br />permitting of the spoil area. The intent was to reclaim to area <br />that was strip mined several years ago. It was understood at that <br />time that control of drainage from the pile during construction <br />was difficult due to the highwall draining from aboue. It was <br />originally proposed to construct a diversion ditch aboue the area <br />to diuert runoff from aboue away from the pile. Rfter discussion <br />with the Diuision it was determined that the slope aboue was too <br />steep and rough for construction of a ditch, From that point the <br />plan was to diuert runoff from aboue over the spoil pile to and <br />down the access road to the bench sedimentation pond. The <br />evidence of the apparent runoff from the pile and down the slope <br />that you observed during your inspection occurred during the <br />major storm event which occurred Rugust 15, 1992. (The storm and <br />resulting damage was reported to the Diuision in my letter to <br />Catherine Begej, dated August 24, 1992]. Rfter your inspection <br />some grading work was done on the pile to facilitate drainage to <br />the access road. the mine experienced a large storm event during <br />the evening of July 14, 1993. (The storm is estimated at <br />approximately 2" in less than an hour). The remedial work on the <br />pile was not sufficient to preuent flow over the slope. During <br />inspection of the site the day after the storm, it was noted that <br />a large amount of water is being diverted into the area by an old <br />road adjacent to the power line to the north of the pile. It <br />appears that the road is collecting runoff from slopes to the <br />Morth of the pile. At this time steps have been taken to force <br />runoff from the pile to the access road by construction a ditch <br />across the pile. Plans are being developed to begin reclamation <br />of the down slopes, provide more positive drainage facilities, <br />and preuent water form the old power line road from entering the <br />pile. Rs I stated in our telephone conuersation, the future need <br />for the spoil pile will be determined by the middle of next week <br />and final plans can be formulated. <br />
