In the event of an ore spill, i.e., if an ore bag was ripped open <br />during the loading or unloading process, the affected area would be very small <br />(less than one ton of crushed material) very obvious, and very easy to clean up. <br />Due to their weight, ore bags are loaded and unloaded one at a time. The <br />possibility of a muti-bag spill at any time, and subsequent exposure to the <br />elements for a significant period of time, is remote given the small loading area <br />and the inconvenience it would represent to both the property owner and the <br />operator. <br />After spending approximately four hours on the site over a two-day period and personally <br />observing both the loading and unloading procedure, l am convinced that the danger, or <br />potential danger, to the environment from ore or related materials is extremely small and <br />easily controlled at this site. If there is a rule or regulation that exempts short-term <br />storage areas for purposes oftransport, I am quite certain this site would qualify. <br />Also, please be advised that Mr. Lance Barker of Au Mining is authorized to represent <br />LKA in this matter before the Boazd.
