NOV C-97-013 <br />Bowie Resources Ltd., Bowie No. 211-line <br />This NOV was issued for failure to follow four regulatory requirements regarding public <br />notification of blasting operations. Blasting operations began prior to the end of a required <br />period following publication of the blasting schedule. Residents neaz the mine were not gi~::~ <br />notices of blasting which are required by regulation. Records of initial blasts at the mine wer„ <br />incomplete. <br />HISTORY <br />No NOV's have been issued at this mine during the past twelve months. No penalty is asse:,~d <br />for history. <br />SERIOUSNESS <br />The regulatory requirements for notifying residents in the mine area of blasting operations are <br />intended to ensure the public's health and safety. Protection of public health and safety is one of <br />the critical components of the Colorado Surface Coal Mining Reclamation Act. Failure to t.:::e <br />required measures to protect the public (local residents, in this case) is a significant violation of <br />the Act. $1250 is assessed for a significant level of seriousness. <br />FAULT <br />The operator had published the required public notice in a newspaper; had sent required notices <br />to some of the property owners in the mine azea; and, had kept records of blasts. However, t:,,ne <br />of these measures were completed in a manner which met regulatory performance standards. .~ <br />low level of negligence is apparent from the failure to conduct blasting procedures in accord.: nce <br />with the performance standards. $250 is assessed for a low level of negligence. <br />GOOD FAITH <br />There is no evidence of extraordinary measures taken to abate this violation. No credit for good <br />faith is awazded at this time. <br />
