<br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF ) <br />~/ ) <br />Ldt/~P' /~ E ) <br />iii iiiiiiiiuiiiiii <br />NOTICE OF VIOLATION <br />•idiB <br />T0: Louis Bendetti and all persons presently owning or <br />requiring now or in the future an interest in the <br />Eastside Coal Pone. <br />PROPOSED FINDINGS OF FACT <br />Pursuant to the authority vested in the Mined Land Reclamation <br />Board by C.R.S. 1973, 34-32-123, as amended (1976 Session Laws, H.B. <br />1065) the Board hereby makes the following findings of fact: <br />1. On December 6, 1978 a member from the Colorado Mined <br />Land Reclamation staff inspected the Eastside Coal Mine. <br />2. A total of 426 tons of coal were removed from the Eas <br />underground coal mine during the period from October 1, 1977 to Oct <br />31, 1978. This mine is located 5 miles north of Silt in Harvey Gap <br />3. On December 8, 1978, a letter was sent to Louis Bendett <br />informing him of the requirements of the Colorado Mined Land Reclamat <br />Act. <br />4. Underground coal mining operations are required to be <br />permitted by the Mined Land Reclamation Board pursuant to the terms <br />Article 32 of Title 34, C.R.S. 1973 as amended (1976 Session <br />H.B. 1065). <br />NOTICE OF VIOLATION <br />l'ou are hereby notified that the facts stated above <br />a violation of Section 109(2), Article 32, Title 34, C.R.S. 1 <br />This section provides: <br />n <br />After June 30, 1976, any operator proposing to engage in a <br />new mining operation must first obtain from the Board a permit as <br />specified to this article. <br /> <br /> <br /> <br />
