Mo. 6: Time for abatement <br />Dear Ms. Smith: <br />Due to circumstances beyond our control, it is necessary to <br />extend the abatement period for subject "Notice of Violation" <br />beyond the 9B day maximum period set-forth in Section 5.03.2 [2) <br />of the Regulations. Factors to consider for extending the <br />abatement period are as follows: <br />1) Draft designs and the application for Technical <br />Reuision Mo. 6 were submitted July 30, 1993 in <br />accordance with the NOU document: <br />2l The application was deemed complete on August 9, <br />1993. Adequacy issues for the application were receiuec~ <br />by Twin Pines October 24, 1993, the reply by Twin Pines <br />was submitted November 24, 1993: <br />3) Proposed decision for final approval of the <br />Technical Reuision was granted December 15, 1993: <br />4) Negotiations with a contractor for completion of the <br />Tech. Reu. was initiated by Twin Pines December 15, <br />1993. Rn agreement was reached with the contractor <br />January 4, 1994.•The contractor was issued a verbal <br />"Notice to Proceed" January 6, 1994: <br />5) twin Pines wild make every reasonable effort to <br />complete the reclamation work by January 31, 1994: <br />6l Interim abatement measures were initiated at the <br />mine site by Twin Pines July 16, 1993 to the extent <br />necessary to minimize harm to the environment; <br />7) The earliest possible completion date for the <br />reclamation work is January 31, 1994. This date is <br />based on absolutely no delays due to inclement weather <br />of any other unforseen circumstances: <br /> <br />8) There has been no lack of diligence by Twin Pines in <br />completing the abatement within the time periods set- <br />
