<br />NOV CV-2000-004 <br />Carbon Junction Mine <br />This NOV was issued for failure to provide a name and contact information for a <br />resident agent, as required by Rule 2.03.4(2)(b). <br />HISTORY <br />No enforcement actions have been issued at this mine during the past twelve <br />months. No penalty is assessed for history <br />SERIOUSNESS <br />This is an administrative violation. Assessment of a civil penalty for seriousness <br />is to be based on the extent to which enforcement is obstructed. Failure to <br />provide the required resident agent information could obstruct the Division's <br />ability to communicate with and provide legal correspondence to the permittee. <br />However, in this instance the Division is still in communication with the permittee. <br />$250 is assessed for a low degree of seriousness. <br />FAULT <br />The permittee was negligent in not providing the required resident agent <br />information after the previous agent was apparently replaced. $250 is assessed <br />for a low degree of negligence. <br />GOOD FAITH <br />This NOV has not been abated. So consideration of good faith is not relevant at <br />this time. <br />
