The following objection is filed on behalf of the above-named Opposers pursuant
to the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board,
Hard Rock, Metal and Designated Mining Operations under §1.7.1. Opposers are
parties provided for in the regulations under 38.1 as they are persons that are directly
and adversely affected or aggrieved by the conduct of a proposed mining operation
and/or an order of the board whose interest is entitled to legal protection under the act.
The following objection is timely submitted under 1.7.1(2)(a) of the
Regulations. The last date for the newspaper publication of notice of the application
was made on January 19, 2007.
Comments are as follows:
GENERAL
As described in the amended application, active mining by Battle Mountain
Resources, Inc. (BMRI) at the San Luis Mine ended in 1997. A major activity on the site
since that date has been implementation and operation of a water management
program to control ground water flows in the vicinity of the Rito Seco and prevent
