Fy~rther, the <br />Division believes that all tailings area monitoring facilitieslshould be <br />sampled monthly and the analytical results reported expedition ly to the <br />Division. This evaluation report shall be submitted to the Di~ision as a <br />technical revision prior to May 29, 1992. <br />Further, BMG shall develop and submit a tailings effluent leak ge <br />interception, containment and treatment plan, to be implemente in the <br />event of contaminant migration from the tailings area. This c ntingency <br />response plan should specify methods to remedy contamination o ground <br />water, surface water and soil. This plan shall be submitted td the <br />Division as a technical revision prior to June 15, 1992. <br />Status: Satisfied - BMG has committed to development of remedial plan <br />in letter of April 16, 1992. <br />- The requirements for monitoring plan modification <br />were only advanced by the Division on April 21, 1992. <br />- BMG verbally committed to modify the monitoring plan <br />on April 22, 1992. <br />Mav Progress: - BMG has met with the Division on May 21, 1992 to <br />discuss preliminary concepts to be included in its <br />revised ground water monitoring plan, to be submitted <br />by May 29, 1992. Copies of this revision i <br />application will provided to the Parties fpr comment. <br />(7) Modification of Ore Processing Methodology: I~ <br />BMG's preliminary suspicions of altered metallic ore content, a d the <br />coincidental failure of the designed processing cyanide recover circuit, <br />are indications that the ore processing methodology currently b ing <br />applied by BMG may require significant modification. If BMG de ermines <br />it necessary to modify its ore processing methodology, BMG shat submit <br />appropriate applications to the Division. Appropriate permit <br />modifications, supported by comprehensive analytical results an design <br />evaluations, shall be submitted by BMG to the Division for revi w and <br />approval no later than 45 days following completion of the cyan de <br />detoxification of the tailings areas contents, described in ite (4) <br />above. <br />Status: Satisfied - BMG has committed to the completion of thelrequested <br />investigations, the development of an appr priate <br />detoxification procedure, and the submissi n of a <br />summary report in a letter of April 16, 19 2. <br />(B> Modification of Tailings Area Reclamation Plan: it <br />The Division is concerned that the introduction of cyanide into the <br />tailings area may be indicative of the inclusion of associated etallic <br />contaminants not originally anticipated in its approved operations and <br />
