The Division received your letter dated December 20, 2004 requesting a hearing before the Mined Land
Reclamation Board to appeal the Division's decision to deny the acreage release request (AR-02) for the Dowe
Flats Mine, Permit No. M-1993-041.
Per your request, the meeting before the MLRB is scheduled for February 15a` and February 16, 2004. The
hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, beginning at 10:00 a.m. on
February 15'" or beginning at 9:00 a.m. on February 16`", or as soon thereafter on each of those days or as soon
thereafter as the matter can be considered. At that hearing you will have the opportunity to be represented and
heard.
Please contact the Board's secretary, Ms. Glenda Williams, at the DMG Denver Office, phone [phone], to
confirm the specific date for the hearing. The Board's agenda may not be finalized prior to the week of the Board
meeting. Therefore, we recommend that you contact Ms. Williams on February 14, 2005. If you find that you are
having difficulty contacting Ms. Williams on that date, you may contact the DMG receptionist at [phone].
Following the hearing, all parties have an opportmity to review and comment on a draft of the Boazd's order
before it becomes final. If you wish to do so, you must provide the Board with a written request to review the
draft order prior to or at the time of your hearing, or you must inform the Boazd orally during the hearing that you
request to review the draft order. You must include your mailing address and, if possible, a fax or email address.
You will be provided a copy of the drab order for your review as soon as it is available. The Board must receive
your comments on the draft order within ten (10) calendar days of the date the draft order is mailed, unless that
deadline is extended. Please note that the Division of Minezals and Geolopv has requested and will be allowed to
review and comment on the draft Boazd Order prior to mailing_to anv uartv. Submit all comments in writing to
Mr. Tyson Powell, Assistant Attorney General, 1525 Sherman Street, Ss' Floor, Denver, Colorado 80203, or FAX
#[phone]. The Boazd will resolve any issues regazding the form and substance of the order. This process
does not affect your right to request reconsideration by the Boazd or appeal the form or substance of the order.
