Dear Mr. Martino:
I have completed my adequacy review of the 110 permit application for the
Pisciotta Pit and have a few questions and comments that I have organized on
an exhibit-by-exhibit basis below. Any exhibits or parts thereof not
mentioned are considered adequate for Board approval now. Please respond to
this letter at your earliest convenience such that I will have time to review
your responses and comment, as necessary, before the scheduled
December 13-14, 1984 meeting of the Mined Land Reclamation Board.
As you are aware, during the same Board meeting, the Board is to consider a
violation against your company for failure to maintain proper financial
warranty on the Zelletti Pit. This matter will be heard before the permit
application for the Pisciotta Pit since it is to be heard as a formal public
hearing. If a violation is found by the Board, Section 120 of the Mined Land
Reclamation Act will prohibit the Board from approving the application for the
Pisciotta Pit. If you cannot resolve this potential violation before the
upcoming Board meeting (presumably, by replacing the cancelled financial
warranty), you will have to request a continuance of Board consideration of
the Pisciotta Pit application until the January 23-24, 1985 meeting of the
Board.
