Any exhibits or parts thereof not <br />mentioned are considered adequate for Board approval now. Please respond to <br />this letter at your earliest convenience such that I will have time to review <br />your responses and comment, as necessary, before the scheduled <br />December 13-14, 1984 meeting of the Mined Land Reclamation Board. <br />As you are aware, during the same Board meeting, the Board is to consider a <br />violation against your company for failure to maintain proper financial <br />warranty on the Zelletti Pit. This matter will be heard before the permit <br />application for the Pisciotta Pit since it is to be heard as a formal public <br />hearing. If a violation is found by the Board, Section 120 of the Mined Land <br />Reclamation Act will prohibit the Board from approving the application for the <br />Pisciotta Pit. If you cannot resolve this potential violation before the <br />upcoming Board meeting (presumably, by replacing the cancelled financial <br />warranty), you will have to request a continuance of Board consideration of <br />the Pisciotta Pit application until the January 23-24, 1985 meeting of the <br />Board. <br />Before the Board can approve the <br />proof of the two sequential weeks <br />(publisher`s affidavit or a copy <br />landowner of the permit area and <br />green certified mail receipts or <br />us as soon as they are available. <br />Exhibit B <br />permit for the Pisciotta Pit, we must receive <br />of publication in a local newspaper <br />thereof) and proof of notifications to the <br />any immediately adjacent landowners (white or <br />a copy thereof).
