BOx 100 Michael R Long <br />San Luis, CO 81152 D~~ision Director <br />RE: Notice of Possible Violation of a Board Order, File No. M-94-103, Sierra Grande Site <br />Dear County Commissioners: <br />On October 25, 1994, the Mined Land Reclamation Board issued Notice of Violation No. M-94-050, <br />requiring that a permit be obtained for this site. Submittal of a complete application was to be done <br />by December 19, 1944. To date, nothing has been received by the Division. <br />We believe this is in violation of a Boazd Order, pursuant to C.R.S. 34-32-124, of the Mined Land <br />Reclamation Act. <br />Therefore, we have found reason to believe a violation exists to the Law and have scheduled this matter <br />before the Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the July 26-27, 1995 Board meeting for consideration of <br />possible violation. The hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, <br />beginrting at 9:00 a.m. or as soon thereafter as the matter can be considered and you will have the <br />opportunity to be represented and heard. It will be reiterated that there is reason to believe that you <br />are in violation of the provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a cease and desist order, assess a civil penalty <br />in the amount of 550.00 to 5200.00 for each day of violation. If you have evidence indicating that the <br />possible violations noted above do not exist or have been corrected, please provide it to us as soon as <br />possible or bring it co the hearing. <br />If you have any questions, please contact Bob Oswald. <br />Sincerely, <br />~~~~~ <br />MICHAEL B.
