_' ' / • <br />_2_ <br />Cease and desist from conducting the following mining operations at the <br />Bartley Pit - Permit M-64-155: on all lands outside the permit area, <br />except that equipment may be removed. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one <br />(1) of this Cease and Desist Order. <br />3. Complete the following corrective action: <br />Operator will apply for a conversion of the 110 permit to a 112 permit, <br />application to be received by the Division by August 21, 1994, and <br />approved within 120 days of submittal. <br />4. The Colorado Mined Land Reclamation Board may assess a civil penalty for <br />this violation. The Board will continue this matter at the <br />August 24-25, 1994 meeting to review the operator's progress or <br />completion regarding the corrective actions and to consider the civil <br />penalty. (Operator is hereby advised that the Board has indicated that <br />it may consider at that time a proposal from the operator to reclaim <br />prelaw, unreclaimed pits, in lieu of assessing a civil penalty. This <br />proposal should be submitted by August 21, 1994.) <br />This Cease and Desist Order shall remain in effect until all terms have been <br />satisfied by the operator. <br />In clarification of the rights of recipients of Notices of Violation, Cease <br />and Desist Orders, parties are advised to consult the Colorado Mined Land <br />Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts <br />to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are <br />advised to consult C.R.S. 24-4-106, as amended. <br />Dated at Denver this \~ day of ~.-,• , ~~ <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />P <br />'4ICH,4EL B.
