_' ' / • _2_ Cease and desist from conducting the following mining operations at the Bartley Pit - Permit M-64-155: on all lands outside the permit area, except that equipment may be removed. 2. Mail, within one (1) day after receipt of this Notice, to the Mined Land Reclamation Board, written notice of your compliance with paragraph one (1) of this Cease and Desist Order. 3. Complete the following corrective action: Operator will apply for a conversion of the 110 permit to a 112 permit, application to be received by the Division by August 21, 1994, and approved within 120 days of submittal. 4. The Colorado Mined Land Reclamation Board may assess a civil penalty for this violation. The Board will continue this matter at the August 24-25, 1994 meeting to review the operator's progress or completion regarding the corrective actions and to consider the civil penalty. (Operator is hereby advised that the Board has indicated that it may consider at that time a proposal from the operator to reclaim prelaw, unreclaimed pits, in lieu of assessing a civil penalty. This proposal should be submitted by August 21, 1994.) This Cease and Desist Order shall remain in effect until all terms have been satisfied by the operator. In clarification of the rights of recipients of Notices of Violation, Cease and Desist Orders, parties are advised to consult the Colorado Mined Land Reclamation Act and the State Administrative Procedure Act. Nothing herein contained, particularly those portions requiring certain acts to be performed within a certain time, shall be construed as a permit or license to engage in any prospecting or mining operations within the State. Persons concerned with judicial review of the provisions of this Order are advised to consult C.R.S. 24-4-106, as amended.
