<br />INFORMATTON ABOUT THE VIOLATTON <br />RULE 5.04.3 (1) <br />NOTICE OF VIOLATION NO. C-93-48 <br />SUBMITTED BY: ENERGY FUELS MINING CO. <br />on APRIL 30, 1993 <br />PERMIT C-82-055 <br />I. FACTS SURROUNDING THE VIOLATION: <br />1. Culvert (Item 1/6) <br />Energy Fuels replaced the culvert at the referenced location with arip-rap road crossing following <br />approval of technical revision No. 06. Prior to placement of rip-rap, a culvert was removed and hauled <br />away. There is still a short section of steel pipe partially buried in the road fill which existed prior to <br />Energy Fuels' mining operations. <br />2. Upper Access Road onto refuse pile (Item #9) <br />This referenced access road is actually a powerline road which was intercepted during construction <br />and expansion of Raton Creeks' refuse pile. This primative, unmainlained mad is not part of the mining <br />operation, as referenced in the information submitted with technical revision No. 06. Energy Fuels regraded <br />the road just above the refuse pile and at the above referenced rip-rap diversion crossing to control surface <br />runoff. In its existing condition, mnoff contained by the road does not enter the clean water diversion. I^ <br />addition, only the last 50 feet of the road captures and directs mnoff to the top of the refuse pile. <br />II. ABATEMENT <br />Energy Fuels has been working to abate the cited conditions since receiving the NOV. Specifically, <br />we have removed the culverts referenced as items no. 1,2,4 and S and restored the ditches. Desig^ <br />calculations are currently being completed for the remaining three culverts. In addition, the check dam <br />structure identified by Item No. 10 as a catchment basin has been removed and the ditch regraded. <br />
