ACE's <br />evaluation will include recommendations for: <br />(a) mitigating any existing adverse impacts to the fkxxiplain, and <br />(b) appending a portion of the reclamation plan to insure long term stability of the river system and flooding. <br />A summary of ACE's findings wiA be provided to the Division no later than 5:00 PM Friday 1 October 2004 for inclusion <br />into the pending Amendment application, scheduled for Public Hearing at the Odnber 2004 Board Meeting. <br />Subsequent to the October Board meeting, it is our understanding that the Division will withdraw the NOV/Reason to <br />Believe, and VCI will wmmence activities to mitigate existing impacts to the floodplain in confomlance with the ACE <br />evaluation. Cor>arrerrtiy, ACE will finalize anti submit the long-term flood control/reclamation plan for review by Weld <br />County and FEMA utilizing the Conditional Letter of Map Revision (CLOMR) process. <br />It will take ACE approximately 2 months to finalize the drawings for the flood control/reclamation plan and it is anticipated <br />that the Weld/FEMA review process may take approximately 6 months. Upon aooeptance of the CLOMR try Weld County <br />and FEMA, VCI will submit the approved flood control/reclamation plan to the Division as a revision to the permit. <br />We trust these commitments mnform with the Division's perspective readied on 14 July, inst Respective of this <br />understanding, please continue the scheduled Board consideration of the NOV/Reason to Believe from the July 2004 <br />Board Meeting to the November 2004 Board Meeting.
