In August, Jim Herron xas on site and suggested
that the ditches be cleaned and suggested that a diverson ditch be cut
on the side of the overburden pile to bring runoff to a point on the rest
side xhere it could be contained in a sediment pond. I personally
cleaned the collection ditches around all the stockpiles shortly after
I received Jim's note. At that time I trtAd xith an eye-level to
establish a line for the suggested diversion ditch but found that a
ditch constructed on a line that would allox drainage xould be so high
on the pile it would be for all practical purposes ineffective.
After I cleaned the ditches and before your inspection Aug, 14th there
xas a rain storm which again filled the ditches xith sediment and breached
in txo places. as you are .aware. After your inspection Larry King and I
rent in and cleaned all the ditches, recovering a small amount of
overburden and cut a diversion ditch from the overburden pile leading
doxn to the pond, xhich should relieve any further problem in that area.
I have and am continuing to maintain the collection ditches around the
stockpile area and suggest that what you xStnessed during your instection
on Aug. 14th was simply the result of an event that had taken place
betxeen the time of Jim's visit and your inspection and that we had not
ignored the suggestion from Jim and consequently were not in violation
at the time of your instection. At any rate, I have performed the steps
deemed necessary to abate and x111 continue to moneter the ditches as is
required.
Thank you and please contact me either through American FLels, Inc, or
at home 846-2382 if you wish further discussion on this or any other matter.
Respectfully)
~~
Earl Madden
