NOV CV-99-008 <br />Eckman Park Mines <br />This NOV was issued for failure to monitor spoil wells, as required by the <br />monitoring plan in the approved mine permit. <br />HISTORY <br />No NOV's have been issued at this mine during the past twelve months. No <br />penalty is assessed for history. <br />SERIOUSNESS <br />Failure to conduct environmental monitoring obstructs the ability of the Division, <br />the operator, and the public to assess the impacts of mining on the hydrologic <br />balance. Since potential impacts to the hydrologic balance due to spoil aquifers <br />and springs are significant at this mine, and since failure to monitor spoil wells <br />was the subject of this NOV, this NOV is considered to constitute a moderate <br />degree of seriousness. $500 is assessed for seriousness. <br />FAULT <br />Conducting required hydrologic monitoring and reporting the results of that <br />monitoring are basic components of the approved mine permit. Based on the <br />evidence at this time, it appears that some of the required monitoring was not <br />done (Fall, 1997 spoil wells) and that results of other monitoring was not reported <br />in a timely or accurate manner. These same problems led to issuance of NOV's <br />to this operator 1994 and 1996. Those NOV's cited failure to conduct required <br />hydrologic monitoring in 1994 and failure to submit a 1994 Annual Hydrology <br />Report in 1996. Based on the apparent failure to conduct all required monitoring, <br />the questionable timeliness and quality of the reporting, and the recurrence of the <br />problems cited in the NOV, $750 is assessed for a high degree of negligence. <br />GOOD FAITH <br />Consideration of good faith is not relevant at this time since the NOV has not yet <br />been abated and terminated. <br />Mines/Eckman NOV 99008 <br />
