<br />-2- <br />CEASE AND DESIST ORDER <br /> <br />Based upon these same Findings of Fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124(2),(6) and (7) the Colorado Mined Land <br />Reclamation Board hereby orders Lake City Mines - LKA International to: <br />1. Cease and desist from conducting the following mining operations at the <br />Golden Wonder Mine - Permit M-78-091 UG: The approximate 0.5 acre affected <br />area situated east of the approved permit area boundary. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one (1) of <br />this Cease and Desist Order. <br />3. Complete the following corrective action: <br />a. Submit an amendment to the existing reclamation permit adding the <br />~ area of the violation to the approved permit area by <br />i,11~,~k~ ti ~ - February 26, 1994 and secure approval of the amendment by <br />April 26, 1994. <br />Mu~~ id (21~_ <br />4. No civil pe al'ty will be assessed if Lake City Mines - LKA International <br />completes the corrective action within the dates indicated. However, the <br />Board will reconsider assessment of civil penalties if the corrective actions <br />set forth under item no. 3 of this Board Order are not completed within the <br />indicated time periods. <br />This Cease and Desist Order shall remain in effect until all terms have been <br />satisfied by the operator. <br />In clarification of the rights of recipients of Notices of Violation, Cease <br />and Desist Orders, parties are advised to consult the Colorado Mined Land <br />Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts <br />to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are <br />advised to consult C.R.S. 24-4-106, as amended. <br />Dated at Denver this ~ day of ._u.~ ~. <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />MICHAEL B.
