Dan Hernandez, Division of Mined Reclamation
streambed of the Animas River. Allen observes: "In my close
elevation work on the Animas River, it has come to my attention that
gravel mining operations above and below Trilmble Lane on the Animas
have substantially lowered the historic river flow level. This is
exemplified in the rapid cutting of the channel on property just
above Trimble Lane."
I have engaged the Durango law firm of McDaniel & McDaniel to
represent me and my mother with respect to a resolution of this
matter with Animas Aggregates. They have been asked to respond to a
letter from Gerald McDaniel by May 10th. We are hoping to resolve
this matter with them short of litigation. However, Dan, in view of
the fact that you indicated an inspection would be taking place here
by the middle of May, I felt it imperative to call the above facts to
the attention of Mined Reclamation at this time.
Therefore, I ask you to examine the Thomas Pit of Animas Aggregates,
File No. M-76-020, to determine if a violation exists. And, I would
ask that your field examiner(s) notify me of their plans to inspect
this operation. I am not alone in stating that I have every reason to
believe that they have violated their permit, and that they should be
ordered to cease and desist immediately.
Thank you for your attention.
You s tr ly,
~- ,
tep en M.
