<br />concerned that the introduction of high cyanide concentrations into the tailings impoundment would <br />modify the tailings chemical constituency which may require a modification of the reclamation plan <br />for the tailings. Therefore, BMR[ was required to submit a reclamation evaluation repott along <br />with a permit revision (and bond increase, if required, pursuant to abatement requirement /110), if <br />a modification of the reclamation plan was warranted. BMRI submitted a reclamation evaluation <br />review report in May, 1993. The report contained static and kinetic test data front several drill <br />holes located in the upper and lower portions of the impoundment. BMRI concluded that the test <br />data demonstrated conclusively that a change in the chemical constituency of the tailings did not <br />occur. <br />After reviewing the reclamation evaluation review repott, and comments from several concerned <br />citizens (who also reviewed the report), the Division sent BMRI an adequacy letter which outlined <br />additional concerns. BMRI responded to the Division's adequacy letter October i, 1993. Except <br />for test result data from three new drill holes (drilled in the tailings impoundment in September, <br />1993), BMRI adequately addressed all the Division's, and concerned citizen's, comments. <br />BMRI submitted test result data from the new drill holes on September 22, 1997_ After review, the <br />Division concluded that a change in chemical constituency did no[ accur in the tailings <br />impoundment as a result of the high cyanide concentrations so, therefore, the reclamation plan <br />does not have to be modified. <br />Modification of environmental monitoring plan: Status; Completed. BMRI submlitted TR-06, TR- <br />08, TR-10, and TR-I5. <br />10. Adjustment of financial warranty: Status; Satisfied. <br />l 1. Critical path project management schedule: Stems; Satisfied. <br />12. Modification of monitoring sampling and analysis protocol: Stems; Completed. BMRI submitted <br />TR-06. <br />Additional Board Ordered corrective action items from June 25, 1992 hearing: <br />1. Initiate the additional ground water monitoring proposed in TR-08: Stems; Completed. <br />2. Use all reasonable practical steps to continue to lower cyanide levels in the tailings pond to the <br />lowest reasonable achievable levels: Stems; Completed. <br />Additional Board Ordered corrective action items from the July 22, 1992 hearing: <br />1. Maintain the WAD cyanide level below 15 pptit in the active tailings pond, and below 10 ppm in <br />the inactive tailings pond: Stems; Completed. <br />2. BMR[ shall implement the Inco process as soon as possible, and bring the tailings pond into <br />compliance as soon as possible thereafter: Stams; Completed. <br />All the NOV abatement requirements have been completed or satisfied so, therefore, NOV M-92-026 is <br />hereby abated. <br />If you have any questions, give me a call. <br />
