In support of this n~uest <br />to vacate the NOV, submitted herewith is information which supports the <br />position of Oakridge that "no "violation ebsted at the mine and the <br />description of the alleged violation by the inspector, Wallace Erickson, was <br />inaccurate, incomplete and without foundation. <br />Frstly, the subject violation was based upon sediment build-up and a <br />partially mashed culvert. I have encosed a copy of the NOV as Exhibit A, <br />attached hereto, for your quidk reference. The performance standard is that <br />the permittee provide culverts to pass the t Oyr. 24hr. event. In this case <br />there are three culverts which are designed to carry a total peak discharge <br />of 39.75cfs. The discharge for which the culverts were designed has been <br />attached as Exhibit B, which is the "East Collection Channel" gathering <br />runoff from the east side of the disturbed area. <br />Flow through a culvert can be calculated from a nomograph, a copy <br />of whidi has been induded as Exhibit C. I have shown the calculation for <br />one culvert on the nomograph in Exhibit C. Each 24" culvert will carry <br />17cfs. Thus, 2.34 of the 24" culverts is need to carry the design <br />requirement of the regulations. Both of the culvert sets of three have the <br />capabiliiy to pass the required event even as constricted by either sediment <br />or by distortion.
