The request has been granted, for the <br />following reason. <br />The situation cited in NOV C-92-008 did not constitute a violation of any regulation for <br />which the operator could be held responsible. The operator had permitted the mine, and <br />implemented the approved mining and reclamation plan in good faith reliance that said <br />approvals were adequate. <br />This Division had failed to require certain documentation prior to approving a permit <br />boundary within 100 feet of a public road at the CCMC mine site. This is considered to be <br />a permit defect for which the operator cannot be reasonably held responsible. <br />At this time, all reasonable abatements and remedies have been achieved. Based upon the <br />above information, NOV C-92-008 is hereby vacated. <br />Sincerely, <br />MICHAEL B.
