Long, <br />Dimsion Director <br />Mr. Mike Keegan <br />Kaiser Steel Resources <br />Star Route 3, Box 60 <br />Pagosa Springs, Colorado 81147 <br />RE: Request to Vacate Notice of Violation C-92-008 -CCMC #1 -Permit No. C-81-024 <br />Dear Mr. Keegan: <br />On August 10, 1992, the Office of Mined Land Reclamation (OMLRI received a request to <br />vacate Notice of Violation (NOV) C-92-008. The request has been granted, for the <br />following reason. <br />The situation cited in NOV C-92-008 did not constitute a violation of any regulation for <br />which the operator could be held responsible. The operator had permitted the mine, and <br />implemented the approved mining and reclamation plan in good faith reliance that said <br />approvals were adequate. <br />This Division had failed to require certain documentation prior to approving a permit <br />boundary within 100 feet of a public road at the CCMC mine site. This is considered to be <br />a permit defect for which the operator cannot be reasonably held responsible. <br />At this time, all reasonable abatements and remedies have been achieved. Based upon the <br />above information, NOV C-92-008 is hereby vacated. <br />Sincerely, <br />MICHAEL B.
