Simpson, P.E. State Engineer ^ The proposed operation does not anticipate exposing groundwater. Therefore, exposure of ground water must not occur during or after mining operations. ® The proposed operation will consume ground water by: ®evaporation. There is no additional exposed ground water or impacts on the existing water rights due to this proposed amendment. Connell Resource, Inc. has indicated that the reclamation plan will no longer include a groundwater lake and that the reclamation plan now consists of backfilling the mine pit to create general agricultural property. ® A well permit was obtained for the current use and exposed pond surface area of the gravel pit, permit no. 42334-F in accordance with Section 37-90-137(2) and (11), C.R.S. A substitute water supply plan is currently pending. Now that the reclamation of the mine site is amended to account for backfilling of the site, replacement of lagged depletions must continue until there is no longer an effect on stream flow. ^ The proposed operation may have potential impact on existing water rights near the project location. Applicant needs to demonstrate that the proposed project will not alter or impact the historic operation of existing water rights. ^ The applicant has indicated plans to use other water for purposes at the permit site. The source of water for this use is to be obtained from Applicant needs to document that this water was diverted in priority under a water right decreed for such industrial use. Applicant should contact the water commissioner for further information. ® It is indicated that that a small portion of the mining area will not be completely backfilled and that area will be lined to create a dry depression in the land surface that could potentially be used as a stock pond. However the proposal to create a lined pond is not part of this amendment. If reclamation of the mine site is amended to include a lined pond, then replacement of evaporation and lagged depletions must continue until there is no longer an effect on stream flow and the lining was approved by the Division 1 Office. COMMENTS: If stormwater runoff is intercepted by this operation and is not diverted or captured in priority, it must be released to the stream system within 72 hours. This may require a discharge permit from CDPHE- WOCD. Otherwise, the operator will need to make replacements for evaporation. The applicant may contact the State Engineer's Office with any questions.
