Notice of Violation No. MV-2002-002, Civil Penalties, and Cease and Desist Order
Dear Mr. Rudibaugh:
C.R.S. 34-32.5-116(3)(a) and (b), 1989 Supp, and Pernut No. M-1995-057 require you to submit to the Division of,
Minerals and Geology $281.00 in annual fees and an annual repoit on or before March 7, 2001 of each yeaz. Check
No. 3461 submitted for Annual Fees was returned for non-sufficient funds. A $25.00 Service Charge was assessed
for return check service. Therefore, you are in violation of the above cited statute and the provisions of Petvilt No.
M-1995-057. Pursuant to C.R.S. 34-32.5-124 the Mined Land Reclamation $oard hereby assesses Notice of
Violation No. MV-2002-002, Civil Penalties in the amount of $281.00, and Notice and Order to Cease and,Desist
from ALL mining related activities associated with Permit No. M-1995-057.
NOTE: NO PERMITS FOR NEW MINING OPERATIONS SHALL BE GRANTED'TO ANY OPERATOR
WHO IS CURRENTLY FOUND TO BE IN VIOLATION IN THIS STATE (C.R.S. 34-32:5-120) UNTIL THE
VIOLATION IS' ABATED.
If you fail to submit your annual fee, $25.00 service charge, and the Civil Penalties assessed by March 14, 2002, this
matter will be heazd at a Formal Public Hearing before the Mined Land Reclamation Board for consideration of
permit revocation and forfeiture of Certificate of Deposit No. 01554, in the amount of $1,500.00, at the Mareh 20,
2002 (or the following day) Board Meeting.
If you submit all past due annual fees, and the Civil Penalties by March 14, 2002, this matter will be withdrawn from
further Boazd consideration.
