BLUE RIBBON MINE PETITION FOR REVIEW OF NOTICE OF VIOLATION Petitioner Blue Ribbon Coal Company, by and through its undersigned attorneys, hereby requests review of Notice of Violation No. C-84-076, dated May 14, 1984, pursuant to CRS §34-33-124, as amended, CRS, §24-4-101 et se ., as amended, and Rule 5.03.5 of the Colorado Mined Land Reclamation Division. In support of its Petition, Blue Ribbon states and alleges as follows: 1. Blue Ribbon is the operator of the Blue Ribbon Mine situated in Delta County, Colorado. 2. Notice of Violation No. C-84-076 (the "NOV") was issued to Blue Ribbon on May 14, 1984, alleging failure to dispose of underground development waste within a permitted area i.e., at the Hotchkiss Coal Yard. It requires that Blue Ribbon remove all such material from the Hotchkiss Coal Yard and dispose of it at an approved site within a permitted area. Upon Blue Ribbon's request, the deadline for this action was extended from June 1, 1984 to August 13, 1984, by Modification dated May 25, 1984. Copies of the NOV and Modification are attached as Exhibit A.
