Thompson <br />Project Engineer <br />R~,^,EIVFD <br />I~~'~~I~~I~~III'I~~ <br />I~AY 2 0 1993 <br />DIV151017 Oi MII101 d1~ ~ Uc~IO Jy <br />Subject: Refuse Disposal Area <br />New Elk Mine <br />Las Animas County, Colorado <br />Job No. 20,122 <br />Basin Resources received a Notice of Violation No. NOV C-93-060 for the New Elk Mine, <br />Refuse Disposal Area (RDA) based upon inspections completed by the State of Colorado, <br />Mined Land Reclamation Division (MLRD) April 12 through 16, 1993. In the Schedule to <br />Notice of Violation, the State identified four steps necessary to abate the violation <br />(remedial action}, including: <br />A. Drain water from standing water pond by pump into pond 008. <br />B. Drain water as much as physically possible from the low areas at the top <br />of the pile by installing dewatering ditches that drain toward the west <br />"Reno Mattress" ditch on the front of the pile, leading to pond 008. <br />C. Provide, per 4.09.1(11)a, a certified report by a qualified registered <br />engineer that, in addition to requirements of 4.09.1(11), describes whether <br />the dirt and rock material being added to the pile is allowable under the <br />approved plan. <br />D. If the material is not allowable, then remove it from the pile. <br />In a meeting held May 3, 1993 at MLRD we were requested to complete the report <br />identified in item C above and to provide our opinion of the acceptability of "dirt and rock" <br />which has been incorporated into the pile from a geotechnical perspective. This letter <br />describes the scope of work completed as part of our subsequent evaluation and <br />presents our opinion whether the RDA is being constructed in substantial accordance <br />with the approved mine plan. <br />1971 WEST 12TH AVENUE DENVER, COLORAD060204 (303)8250777 <br />
