-z- II. CEASE AND CESiST ORCER Based upon the foregoing Findings of Fact and Notic=_ of Yiotation, and pursuant to the provisions of C.R.S. 34-32-123, the Board hereby orders you to: 1. Immediately cease and desist all mining operations. 2. Mail, within one (1) day after r?caipt of thi; Notice, to the Mined Land Reclamation Bcard, written optic? of your compiianca ~.vith paragraph one (1) of this Cease and Desist Order. III. CORRECT I'/E ACTIONS Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Bcard by C.R.S. 34-32-124(2), the Board hereby orders the following corrective actions: Obtain by July 23, 1992 a Limited Impact 110 (2) permit for reciamation only of the disturbed area (including redisturbed land). 2. Complete the reclamation work approved for the permit above by May 1, 1943. 3. The Board further orders you to appear before the Board at its July 22-23 Board Meeting for a report on progress toward these corrective actions. IV. CIVIL PENALTY Pursuant t0 the authority vested in the State of Colorado !tined Land Reclamation Board by C.R.S. 3a-32-123(3), and bases upon the foregoing Findings Of FdCt, the Bcard hereby asseres a civil penalty against C ~ J Gravel ?roducts, Inc. in the amount of 57,300.00 based on tie maximum of o0 days of violation at 5130.00 per day. The Boars orders that 51,000.00 of the civil penalty be pain within 30 days of this Grder. The remainder of the civil penalty will be held in abeyance until the Board's Juty 22-23, 1992 meeting, at which time the hearing will be continued and the Eeard will consider the remainder or the civil oenalt~. In clarification of the rights of recipient; of Nctic=_s or Violation, Cease and Desist Order;, Corrective Actions and Civil Penalties, parties are advised to consult the Colorado :Mined Land Reclama_ion Act and the State Administrative Proc=_dur2 Act. Nothing herein contained, particularly those portions requiring certain acts to be performed ~.vithin a certain time, shall be construed 3; a permit or license to engage in any prospecting or minine operations ~•~ithin the State.
