Cottony <br />Division Direc[or <br />Natural Resource Trustee <br />The Division received your adequacy response comments on December 12, 2006 regazding the <br />Conversion Application (CN-Ol) for the Colorado Marble, L.L.C. Lilly Mines, Permit No. M-1987-028. <br />The Division has the following items that need to be addressed prior to approval of the application. <br />As required by Rule 1.6.2(1)(g), please submit the proof of publication of the public notice <br />circulated in the local newspaper, all owners of record of surface and minerals lands, easement <br />holders, and owners of record of surface lands that are within 200 feet of the boundary of the <br />affected land. Proof of notice may be return receipts of a Certified Mailing or by proof of <br />persona[ service. <br />2. The operator states that the permit will be transferred from Colorado Mazble LLC to Colorado <br />Marble Inc. The Division has not received the necessary paperwork in order to transfer the <br />permit. Please be aware that the transfer must be approved prior to the approval of the <br />Conversion Application. <br />The operator states that a temporary road will be constructed to route FS Road 228 until a more <br />permanent location can be negotiated with the Forest Service and approved by the Division in the <br />form of a revision to the permit. Please locate the temporary road on the mine plan map. In <br />addition, the operator states that a notarized letter from the Forest Service agreeing to the <br />temporary road re-location within the mining area will be sent to the Division. Please provide a <br />copy of this letter. <br />4. The revised text on page 9 states that the FS Road 228 will cross Taylor Creek, yet in other <br />sections of the application it is stated that the road will be diverted west of Taylor Creek. Please <br />clarify this discrepancy. <br />5. The operator states that the 0.25 acre of disturbed ground located within the Shamrock Claim was <br />reclaimed to original conditions in 2006. Colorado Mazble sent a letter to US Lime requesting <br />their approval of this action and requested a formal statement to that affect. Please forward the <br />referenced letters to the Division for our files. <br />6. The operator states that the reclamation plan will address final closure criteria for the shaft at the <br />end of mining. The Division was unable to locate text in the reclamation plan that pertains to <br />final closure of the historic mining features that are disturbed by the active mining operation. <br />Please further describe the reclamation plan for these structures. <br />Office of Office of <br />Mined Land Reclamation Active and Inactive Mines <br />
