Long <br />Division Dnecror <br />RE: REQIIEST TO MODIFY/VACATE NOTICES OF VIOLATION C-94-0247C-5y•OZ.~ <br />C-94-026, C-94-2~7 - Slurco Corp. - Canadian Mine <br />Permit No. C-81-026 <br />During February, Slurco Corp. requested a Board Hearing to consider <br />vacating the above-referenced Notices of Violation. As of March 7, <br />1994, Slurco has requested that we consolidate the Notices of <br />Violation, as an alternative to Board consideration. The request <br />has merit, and I recommend the following actions: <br />1) Modify Notice of Violation C-94-024, to cite a general <br />"failure to meet certain impoundment standards", and to <br />specifically include "failure to provide evidence that <br />the impoundments were inspected by, or under the <br />direction of a qualified professional engineer". <br />The original C-94-024 was written for failure to meet <br />certain impoundment performance standards, specifically <br />rules 4.05.9(1)(e) and (f), and 4.05.9(8). This <br />modification 'would be consistent, and would add rule <br />4.05.9(13).. <br />2) Vacate Notice of Violation C-94-027 which separately <br />addresses the missing P.E. certifications on certain <br />impoundment inspection reports. The contents of this <br />violation would be appropriately addressed in the <br />modified C-94-024. <br />3) Modify Notice of Violation C-94-026 to include a general <br />citation such as "failure to maintain records in a proper <br />manner", then add a specific citation which references <br />the late .1993 Annual Hydrology Report submittal of <br />January 6, 1996. Notice of Violation C-94-026 currently <br />references a failure to have certain records available <br />for public review at the Jackson County Courthouse. Both <br />situations involve maintenance of administrative records, <br />and neither situation resulted in any negative consequence. <br />
