Also enclosed is a copy of their reply <br />dated Mazch 20, 2002. You can see that they say: "The work does not include any discharges <br />of dredged or fill material into waters of the united States. Therefore, the proposed project <br />is not regulated under the provisions of Section 404 of the Clean Water Act and a Department <br />of the Army Permit will not be required." <br />This is consistent with a ruling I received on a similaz project in northeast Colorado from the <br />Omaha Field office. <br />Cordially, <br />J~/~ .~~. <br />Lloyd V.
