Renner 2 <br />State's response to be good cause for not taking action at this time if <br />the regulatory authority requires a reasonable and specified time to <br />determine if a violation of the State program exists. <br />As noted in MLRD's response, the violation identified in this TDN was <br />also discussed during the recent oversight meeting between AFO and MLRD <br />on April 10, 1991. During those discussions, MLRD agreed it was <br />inappropriate to reduce bond for reclamation work completed and that it <br />would re-evaluate the bond adjustment issue. With that in mind, the <br />request for an extension in time for the preparation of the <br />documentation concerning this violation will be granted. AFO is <br />granting MLRD an additional 15 days after receipt of this letter to <br />provide that information. At that time, AFO will consider the <br />information presented and will make a finding as to the appropriateness <br />of MLRD's response to the TDN. <br />Until this matter is resolved, AFO requests that MLRD take no further <br />steps in the bond release process for this mine. It is the <br />understanding of this office that MLRD still holds the total bond for <br />the permittee, pending a substitution for the reduced amount as <br />released.
