Mr. Steven G. Renner 2
State's response to be good cause for not taking action at this time if
the regulatory authority requires a reasonable and specified time to
determine if a violation of the State program exists.
As noted in MLRD's response, the violation identified in this TDN was
also discussed during the recent oversight meeting between AFO and MLRD
on April 10, 1991. During those discussions, MLRD agreed it was
inappropriate to reduce bond for reclamation work completed and that it
would re-evaluate the bond adjustment issue. With that in mind, the
request for an extension in time for the preparation of the
documentation concerning this violation will be granted. AFO is
granting MLRD an additional 15 days after receipt of this letter to
provide that information. At that time, AFO will consider the
information presented and will make a finding as to the appropriateness
of MLRD's response to the TDN.
Until this matter is resolved, AFO requests that MLRD take no further
steps in the bond release process for this mine. It is the
understanding of this office that MLRD still holds the total bond for
the permittee, pending a substitution for the reduced amount as
released. The current bond should be held until this matter is
resolved.
If you wish to discuss this matter further, please contact Steve Rathbun
or me at (505) 766-1486.
Sincerely,
Kober't H. Hagen,~l~rector
Albuquerque Fie~.d Office
