As stated in the application, the applicant needs to revise the County floodplain use permit. <br />However, this needs to be done prior to any mining in the new 8-acre area, not during mining <br />as the last paragraph on page 8 states. <br />We have the following comments on prior amendments that we believe should have a bearing on the <br />County's decision to approve this amendment: <br />2. The applicant has stated that the mining work in the 6.2-acre area (referred to, in this <br />application, as "Area 2") has been backfilled. However, it is unclear as to when this azea is <br />scheduled for revegetation. The table on page 8 of the application identifies this area as being <br />revegetated in Phase 1. Is Phase 1 expected to begin 1 to 3 yeazs from now or 1 to 3 years from <br />the original year 2000 conditional use permit? The District believes this area should be <br />revegetated immediately to provide much needed erosion control in this area. According to the <br />original conditional use permit application, dated July 24, 2000, this area was to be revegetated <br />with "native wetland type plants." <br />3. As part of Asphalt Specialties' last amendment application for the addition of approximately 15 <br />acres (also known as Sweetman addition), it was our understanding that the County required <br />the applicant to address the Henderson Creek flows that the proposed reservoir would <br />intercept. We believe the applicant chose to accept creek flows into the proposed reservoir <br />rather than route them around. On referral from Adams County, the District reviewed the first <br />set of Henderson Creek reservoir inflow and outflow structure plans submitted several months <br />ago by the applicant's consultant, but we have not heard back as to the status of our comments <br />or the design.
