Please consider this
letter to be a letter cf objec=ion supplementing cur initial
letter of objection cn this application dated April 17, 1997 . We
are submitting this s :p_ pie_ae-tal letter within five days
following the -nfcrmal pr=_hearing conference, as your rules
recuire .
We have two acd: __cna_ objections to make to the amendment
aool_ca=icr. . Fizst, the amendment application is deficient in
that it does not include the levee embankment (or so-called berm)
which predated the original application for the Deepe Farm Pit,
but has been sucStantlallV mcd-fied during the _permit's term. We
included th15 Obj eCt'-Cn in cur April 17 letter. Fowe`ler, we
learned at the May 6 conference that Western Mobile, following
the slbm_ss_on cf t!'1e cend'_ng amendment, add led for a "technical
revision" to the plan to include cartain proposed changes to the
berm. Apparently the DM_G staff received the proposed technical
revision on the morning cf the May 6 pr=_hear_ng confere Tice .
Needless to say we are disturbed by this unexpected development.
It ac_pears to us to be an end-run around the amendment process
which we had assumed would be the aporopriata forum for
addressing the serious flocdol=_in issues related to the berm.
EXHIBIT
1 I
Jere L Md Ce[ Rcnac C i:awe- PC,,7cs^
Caurr,Can^;=cnw Ca:nrf Gr,.ciu:cna.
