<br /> <br />-2- <br />NOTICE OF VIOLATION <br />"sa <br />Based upon these same Findingg of Fact and in accordance with <br />C.R.S. 34-32-124(6), the Color~tb Mined Land Reclamation Board <br />hereby finds L. Otto Goemmer to be in violation of Permit M-82-129, <br />specifically Exhibits 3(a)-(e) and Section 34-32-117(6)(a), C.R.S., <br />for failure to maintain the Financial Warranty in good standing for <br />the life of the permit. <br />NO CEASE AND DESIST ORDER WILL $E ISSUED PURSUANT TO THIS VIOLATION <br />1. Complete the following corrective action: <br />The required interim bond is in place, therefore no other <br />corrective action is required. <br />2. Pay the Colorado Mined Land Reclamation Board a civil penalty <br />in the amount of $0. Due to the nature of the violation and this <br />Office's contributory actions, there will be no Civil Penalty <br />assessed. <br />In clarification o!` the rights of recipients of Notices of <br />Violation, Cease and Desist Orders, parties are advised to consult <br />the Colorado Mined Land Reclamation Act and the State <br />Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring <br />certain acts to be performed within a certain time, shall be <br />construed as a permit or license to engage in any prospecting or <br />mining operations within the State. <br />Persons concerned with judicial review of the provisions of this <br />Order are advised to consult Section 24-4-106, C.R.S. 1984, as <br />amended. <br />Dated at Denver this 3 day of May, 1994. <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURC <br />MICHAEL B.
