<br />Mr. Darrel llespe <br />June 2, 1981 <br />Page Two <br />After reconsideration of the civil penalty, including good faith considera- <br />tion, the Division proposes civil penalty of $700.00 for N.O.V. 8I-10. <br />l4ith regard to N.O.V. 81-1I, it is clear that the operator disposed of refuse <br />outside the permit area. Because the Division was not notified before the <br />operator took the activity, it is not clear what consideration was given <br />to the environmental affects prior to the disposal, in addition to the fact <br />that it was an unauthorized disposal. (Section 34-33-121(2)(d).) She <br />operator has taken appropriate steps to rectify problems associated with <br />the activity. <br />Based on the facts presented and good faith considerations, the Division <br />proposes a civil penalty of $700.00 for N.O.v. 81-11. <br />During the assessment conference it was stated by the operator that they <br />were considering future activity in other abandoned areas which would be <br />outside the permit area. It was believed that this activity may improve <br />the condition of the land in those areas. If the operator is considering <br />such improvements and if the improvements relate to the activity of the <br />mining operation, I recommend that he notify the Division.
