Long
Orvismn Dirodor
On May 24, 2000, the Mined Land Reclamation Board approved the continuation for 60 days of its consideration of
a possible violation at the San Acacio Pit for failure on the part of the County to protect areas outside the affected
land from damage during the mining operation and reclamation. This would bring the matter back before the Board
during its July 26-27, 2000 meeting.
The continuance was in response [o the County's request for additional time in order to obtain a signed and
notarized affidavit from the adjacent landowner whose property was potentially damaged by the County. In the
affidavit proposed by the County for his signature, the landowner will indicate that he does not believe his land [o
have been harmed by the County's activities and would, if asked, have given the County permission to conduct the
activities in question on his property. At the recommendation of the Assistant Attomey Ceneral, the Division
requested certain modifications be made to the affidavit proposed by the County. A copy of those suggested
modifications was provided to Mr. Martin Gonzales, Costilla County Attorney, following the meeting.
The continuation of [he Board's consideration of the possible violation was accompanied by the requirement that
the County submit the signed and notarized affidavit with the requested changes by July 12, 2000 for review by the
Assistant Attorney General and the Division.
So far as is currently known, the July 26-27, 2000 meeting of the Board will be held in Room 318, 1313 Sherman
St., Denver, Colorado. The Formal Public hearing on the possible violation a[ [he San Acacio Pit will begin at 9:00
a.m, or as soon thereafter as the matter can be considered and the County will have the opportunity to be
represented and heard.
If you have any questions, please contact me at (303) 866-3898.
Sincerely,
J at.ti~c-~ G ~ [,~.Lt.~
James C.
