SHELTO N, Director <br />July 8, 1985 <br />Mr. George Speer <br />Speer Development <br />12021 Brighton Boulevard <br />Henderson, Colorado 80640 <br />Re: Speer Development - Action taken at the June 26, 1985 <br />Formal Hearing of the Mined Land Reclamation Board. <br />File No.: 83-176 <br />Dear Mr. Speer: <br />Upon review of information provided by the Division staff and Mr. Jack Thoms, <br />the Board found the operator in violation of permit No. 83-116, for operating <br />contrary to the permit by mining in the South Platte River. The Board issued <br />a Cease and Desist Order on any further mining and mine related disturbance <br />within 200 feet of the South Platte River as outlined in the permit with <br />corrective action to be removal of equipment and stockpiles from the setback, <br />removal of the sand material deflector from the river, grading and <br />revegetation to be completed within 60 days. For this violation, the Board <br />levied a civil penalty of $100 per day for 42 days for a total of $4,200.00, <br />of which the Board would dismiss $3,500.00 if corrective action is completed <br />within 60 days from the date of the Board meeting. The remaining unsuspended <br />civil penalty of $700.00 is due and payable within 30 days from the date of <br />the Board meeting. <br />Also, at this Board meeting, the Board approved the technical revision dated <br />May 30 1985 with no change in financial warranty. <br />I look forward to hearing from you shortly concerning the corrective action <br />and civil penalty which is due.
