Thus, the Service concludes that the Proposed project on this srte should not <br />have duect adverse affects to Preble's. Should Preble s populations exist downstream from the <br />site, actions on the site that result in significant modifications of Preble's habitat downstream (for <br />example, through alteration of existng flow regimes, or sedimentation) may be subject to <br />provisions of rite ESA. <br />Additionally, a Section 404 ppeetvrit may be reGG~ired by the U.S. Army Corps of Engineers under <br />the Clean Water Act (33 U.S.C.1344 et segqJ if the proposed constnrction may Impact <br />jurisdictional wetlands or waters of the U.S. a[ the subject site. <br />Please note that this clearance is valid for one year from the date of this letter. Should additional <br />infomration on listed or proposed species become available, [his determination may be <br />reconsidered under the ESA.
