Long <br /> Division Director <br />RE: Sierra Grande Site, File No. M-94103, Notice of Possible Violation of a Board Order <br />Dear Mr. Vasquez <br />On August 24, 1995, during a hearing of the Mined Land Reclamation Board, Costilla County was ordered to have <br />obtained approval of a 110 permit application on or before October 23, 1995. The permit required has not been <br />obtained, despite numerous attempts by the Division to assist the applicant. <br />We believe this is in violation of the Boazd Order, issued as a result of Notice of Violation <br />No. M-95-057, pursuant to C.R.S. 34-32.5-124, of the Colorado Construction Materials Act. <br />Therefore; we have found reason to believe a violation exists to the Law and have scheduled this matter before the <br />M'med Land Reclamation Board. <br />A Formal Public Hearing will be held during the March 27-28, 1996 Board mce[iag for consideration of possible <br />violation. The hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, beginning at <br />9:00 a.m. or as soon thereafter as the matter can be considered and yeu will have ate opportunity to be represented <br />and heard. It will be reiterated that there is reason to believe that you are in violation of the provisions noted above. <br />If the operator wishes to waive his right to a 30-0ay notice of a hearing so that this matter can be heard ar the <br />Febrtary 21-22, 1996 Board meeting, a written waiver of the 30-day notice mttst be received by this office by <br />February 1, 1996. <br />If the Board fords a violation at this hearing, it may issue a cease and desist order, assess a civil penalty in the <br />amount of $100.00 to $1000.110 for each day of violation.
